Class Action - AWB Limited advises that the class action filed on behalf of Mastafa and Ismail, two Iraqi widows who were bringing a claim against AWB on behalf of a class of Iraqi citizens, has been dismissed by the US District Court for the Southern District of New York - AWB had filed a motion to dismiss this class action complaint which has been granted by the Court - the plaintiffs have 30 days to lodge an appeal against the dismissal - AWB has previously stated that it was of the opinion that the case was ill-conceived and that it would vigorously defend the action

Class Action - at a hearing today an application by AWB to strike out the claim against it, on the grounds that the Court cannot or should not consider questions relating to the United Nations and Iraq, was dismissed - the Court also directed that any 'Reply' to the Defence filed by AWB be lodged by 21 March 2008 and that categories of documents to be discovered by AWB be agreed between the parties by 11 April 2008 - the case is back in Court for further directions on 6 May 2008

Class Action - after being served with the claim, AWB Ltd sought further particulars of the claims being made against the company - those particulars have since been supplied to AWB by the Applicants - in August the proceeding was converted from a proceeding under Order 6 rule 13 of the Federal Court Rules into a proceeding under Part IVA of the Federal Court of Australia Act following an application brought by the Applicants and heard by Justice Gyles on 22 August 2007

the law firm of Cohen, Milstein, Hausfeld & Toll, PLLC today filed a class action lawsuit against AWB Limited on behalf of American wheat farmers in the federal district court in New York City (AWB allegedly paid bribes and kickbacks to the Saddam Hussein regime in exchange for exclusive contracts for wheat sales under the United Nations' "Oil for Food Program" and to keep its competition -- American-grown wheat -- out of the Iraqi market - as a result, American farmers were stuck with an oversupply of wheat during that period which depressed the prices at which they could sell their wheat)

Maurice Blackburn Cashman has been instructed to commence proceedings against AWB Limited on behalf of its shareholders - proceedings will be filed soon - IMF (Australia) Ltd is funding the proceedings and has offered to fund litigation for AWB shareholders who are eligible to participate (Generally, those shareholders who purchased AWB shares on ASX between 11 March 2002 and 13 January 2006 and held some or all of those shares as at 13 January 2006 may participate) - shareholders interested in joining this action should contact Ben Slade, Jason Geisker or Juliana Tang at MBC on (02) 9261 1488, or register their interest by completing the AWB Registration Form

reports that Maurice Blackburn Cashman is investigating whether shareholders in AWB have a case for launching a class action against the company to recover share price losses - Ben Slade of MBC is reported to have said it was clear from evidence submitted in the Cole Inquiry and information given to the ASX by AWB about its dealings with the Iraqi Grains Board that shareholders were not advised of all information that could affect the share prices
